If you are in a relationship with a British citizen or somebody that has settled status in the UK and you are a non-EEA national and plan to get married in the United Kingdom, then you will need to apply for a fiance visa or a proposed civil partner visa.

To be eligible for this visa, you have to prove the following:

  • You and your fiancé or proposed civil partner are both 18 years old and above
  • At the time of your application, you have been in a relationship for a minimum of 2 years
  • Any former unions (marriage or civil partnerships) have been formally and legally ended
  • Provide evidence for the intention of marriage or civil partnership within 6 months of arriving in the United Kingdom

The fiance visa allows you to stay in the United Kingdom for up to 6 months that can be extended through a spouse visa application once married.

 

What happens after marriage

Once you are married and if you intend to stay in the United Kingdom, you are eligible to first apply for the ‘Leave to Remain’  and then the ‘Further Leave to Remain’ visa.  After 60 months of lawfully limited leave as a partner, you can apply for the ‘Indefinitely Leave to Remain’. If successful, it is then a 12-month wait before you can begin the process for Naturalisation.

When you have successfully applied for a Spouse visa, you are permitted to work and have the same rights as your spouse in the United Kingdom. Additionally, if there are any dependents under the age of 18, they will be able to come to the United Kingdom under the Spouse visa application.

Fiancé Visa Appeals

A Fiance visa can be refused and in that situation, you can appeal the decision.

The most common reasons for refusal are:

  • You did not meet the English language requirements
  • You applied for the wrong type of visa
  • The documents you submitted with poorly organised
  • You did not disclose criminal convictions
  • You have not followed the Home Office application guidelines

If you are in the United Kingdom, then you have 14 days (from the day you received the decision) to appeal your rejection. If you are not in the United Kingdom, then you have 28 days to appeal the decision.
