Settlement Visa

Settlement Visa Solicitors

Applying for a settlement visa can be daunting given the complexities of the process. The sheer number of regulations can be overwhelming, and one error can result in the rejection of the application. Therefore, it is advisable to seek out legal help where possible.

What is a settlement visa

A settlement visa allows you to live, work and study in the United Kingdom (albeit with a few restrictions). The most commonly sought visa is the ‘Indefinite Leave to Remain, which gives you the right to permanently live in the United Kingdom, but it does have strict criteria for eligibility.

If you are not eligible for the ‘Indefinite Leave to Remain’, you can consider applying for ‘Further Leave to Remain’.

When can you apply for indefinite leave to remain

It’s imperative that the application for a new visa begins before the current one expires. If you begin the application after, it may result in you having to leave the country and will make the process unnecessarily complicated.

In order to be eligible for ‘Indefinite Leave to Remain’, you have to have lived in the United Kingdom for 5 years. This could be the product of living on other visas or if you are an EEA or Swiss national. Aside from this, there are other requirements that applicants have to fulfil, including fluency in English. To ensure that you are eligible, it is highly advisable to consult our legal experts to identify any potential obstacle that could become a problem in the application process.

How long can you stay once you have a UK settlement visa

If successful, the ‘Indefinite Leave to Remain’ status allows you to stay in the United Kingdom as long as you want. However, it is important to remember that this status can be revoked at the discretion of the Home Office if the applicant continuously lives outside the United Kingdom for more than 2 years.

Can I bring my family

Those with ‘Indefinite Leave to Remain’ status may be eligible to bring their partner and/or any dependent under the age of 18 to the United Kingdom under the settlement visa.

How long does the settlement visa application process take

The process for the settlement visa can take up to 6 months, from the initial application to the final decision. This process can be expedited if you are eligible for the Home Office’s premium service.
